Answers to Child Support Questions You May Have
How is child support calculated?
Child support is calculated based on a program that varies slightly by County. The main factors that the child support programs consider are:
the incomes of the parties;
the number of overnights each parent has with each child;
the number of children;
daycare costs for any child; and
the costs of health insurance for the children.
The guidelines that govern child support in Michigan are found in the Michigan Child Support Formula Manual. The most current version of this Manual is available here:http://courts.mi.gov/Administration/SCAO/Resources/Documents/Publications/Manuals/focb/2013MCSF.pdf
We have a child support program available at our office, and we will be happy to provide you with our assessment of what amount of child support you can expect to pay or receive.
I cannot afford child support because of my expenses, will the Court consider that?
Not usually. Child support is based on the factors listed above.
Does child support have to be paid through the Friend of the Court?
No. Child support can be paid directly from one party to the other. Also, if both parties agree, and neither party is receiving government assistance, the parties can opt out of Friend of the Court services. If this is done, either party can opt back in at a later date.
If one party has no source of income, will child support be based on $0 for that parent?
Not usually. Usually a party with no source of income that has the ability to work will be "imputed" income. This means that even though the party does not have any income, they will be treated as if they do in an amount determined appropriate by the Court.
